I am currently in maternity leave, but I have a partner with whom we want to start a company. My partner works on an employment contract, and I am a mother - can I open a company with him and work in it.

In principle, there is no problem for you or your partner to find a company in the name of one of you.

Problems will arise only for you later, when the company itself begins its activities, namely:

- if the company is in your name, you will have to be issued insurance when starting business. In this case, depending on what period of maternity you are in, they will stop your maternity leave completely or pay you 50% of it. The same applies if the company is in the name of your partner, but you are employed on a contract basis in the company.

- if the company is in the name of your partner and you are not employed, but still do some work in connection with the activities of the company and this is established by the relevant authorities, then in addition to stopping your maternity, it will be imposed a fine from the Labor Inspectorate, both to the company and to you, as an individual.
