I have a teacher who is on sick leave due to a high-risk pregnancy. The required 180 days expire in two months. Until then, I, as director, must increase teachers' salaries from the beginning of the year. My question is, should the teacher, who will return to work in two months after the expiration of her sick leave, also have to increase her salary? Or before I do, does she have to have worked a few days (and how many)?

An employer may change a unilaterally concluded employment contract without the consent of the employee only if he increases the remuneration already agreed with a signed employment contract. This means that you are not obliged to be at work (not in hospital) in order to issue an additional agreement to an already signed employment contract for salary increase. The person will sign it when appearing at work. In practice, this will not change the already calculated benefit that the worker will receive during the maternity leave. This increase will be used effectively after returning from hospital, although it will be made from 01.01.
Another issue is if the additional agreement is to reduce the remuneration agreed with a signed employment contract - in this case this agreement is not valid without the signature of the employee, who while in hospital can not sign.
