Termination of a pregnant person's employment contract
Termination of a pregnant person's employment contract
Question:
Hello!
I'm pregnant and not feeling well, but my employer doesn't want to let me work from home and wants me to work until the end. In 2 days my trial period of 6 months ends. Can I go on sick leave the next day or will they still have the right to release me then?
Thanks in advance!

Answer:
Hello,
While you are in hospital, your employer cannot release you, except with permission from the Labor Inspectorate in the following cases:
1. When closing a part of the enterprise
2. When reducing the volume of work
3. In the absence of the employee's qualities, to perform his duties effectively
4. When changing the requirements for the position held by the employee, to which the employee does not meet
5. Disciplinary Dismissal.
In practice, it is difficult, but not impossible, to obtain such permission from the Labor Inspectorate.
Separately, without permission from the Labor Inspectorate, your employer may dismiss you without giving you notice or requiring your consent
6. Due to expiration of the contract (if the contract was concluded for a certain period).
7. While on probation.
8. If you mutually agree on compensation for the employer to pay you.
9. By mutual consent (ie you agree to be released without agreeing to additional compensation).
We hope we have been helpful!
Greetings!
