Supply of services and intra community acquisition Invoice Term
Supply of services and intra community acquisition Invoice Term
Question:
Hello,
I am addressing you with one case study on company accounting. According to Art. The VAT invoice shall be issued not later than the 15th day of the month following the month in which the tax event for the delivery occurred. No later than the 15th day of the month following the month in which the tax event for the supply occurred, an invoice for an advance payment received in connection with this intra-Community supply shall also be issued.
In this case, we have an international service contract (to make an analysis). The protocol for accepting the development is from 6.12.2016. , and the corresponding invoice is from an Austrian company and dated 22.12.2016.
The point is, since our accounts tell us that the timeframe between the invoice and the protocol is 5 days, but that is for the Bulgarian contracts. In the above case, Art. 113 (5), how is it interpreted? But, WATER, mean only supplies! Help the time in our case.
Thanks!
Answer:
Hello,
First of all, you have service and not WATER (we have a supply of goods).
Since we have no VOD, the provision of Art. 113/5 / does not apply to your case and the applicable provision is Art. 113 (4) - up to 5 days from the tax event. Article 25 (2) determines when the tax event occurs - in your case the date of acceptance of the development / analysis - 06.12.2016. In terms of company accounting, an invoice should be issued until 11.12.2016.
However, from the point of view of fiscal discipline, we think that you will not have a problem with the NRA because the tax event and invoice issue are in the same month and with your actions you do not detract from the budget.
We hope we have been useful.
Greetings.
