SOL and labor contract
Question:
Hello!
The self-insured person, the manager of OOD, decides that he wants to conclude TD in the position of Manager.
In such a case, when he is the manager of the TD, does the grounds for self-insurance fall or should both grounds be insured? And if the reason disappears, I suppose there should be a discontinuance statement?
I will be grateful to hear your opinion on the following question: Can the owner of EOOD conclude TD with him as Manager?
Thanks and kave a nice day!
Answer:
Hello,
Already with the registration of the company with the memorandum of incorporation, a manager is selected and it is entered in the Commercial Register.
With the start of the business of the company, the elected manager has to conclude with him the Management and Control Contract (PQM) of the company. Most of the managers, as they do not want to pay high insurance, prefer to insure themselves as Self-insured persons (SALs) and in this case indicate in the management contract that they will manage without remuneration. If you change the management contract and make an annex to the contract in which you determine the remuneration for the management of the company, then you are obligatory to be insured under the SSC (minimum on the minimum insurance threshold for the first category for the activity of the company). In the declaration, which is submitted to the NRA when the change is made, you only declare the termination of the insurance as a SAL, but not of the activity.
Then you will receive a salary at DUK. TAB is equal to employment contracts but not an employment contract.
We hope we have been helpful.
Greetings!
