Concluding an employment contract during maternity leave
Concluding an employment contract during maternity leave
Question:
Hello!
If an employment contract is concluded during the maternity leave of a self-insured person (free profession), will it be possible to receive the full benefit for a child until the expiry of the benefit received on the basis of self-insurance?
Do I have to submit documents to the National Social Security Institute, the National Revenue Agency, the new employer that I have started working under another legal relationship during maternity (or that I will not use leave under the new legal relationship) or is the law observed? Are standard taxes and insurances paid on the employment contract or are there any changes?
Thanks!
Answer:
Hello,
After 135 calendar days from your maternity leave, you can start working on another legal relationship / grounds and will continue to receive the full amount of the benefit you received. However, the condition is that you do not use leave under the newly started legal relationship / grounds.
In principle, your new employer submits the standards documents that he would submit for each person who comes to work for him. No additional documents are submitted related to the fact that you are on maternity leave as a SAL. The insurances due by your new employer are not affected by the fact that you are on sick leave as a SAL, ie. standard taxes and insurances will be due.
We hope we have been helpful.
Greetings!
