Work Permit Abroad
Question:
Hello!
I am interested in opening a Bulgarian company with the right to work in Belgium. The activity will be sowing flowers.
Thanks in advance!
Answer:
Hello,
If a Bulgarian company has a contract with a Belgian company regarding the services it will provide on the territory of Belgium, it is not a problem for the Bulgarian company to work there.
The more important part is that if the Bulgarian company has employees who work in Belgium, the Bulgarian company will have to provide the individuals with an amount not lower than the minimum wage in Belgium for the specific activity, and in order for the insurance to be paid in accordance with Bulgarian legislation and in Bulgaria, these individuals must be issued an A1 certificate. In order to obtain this document, the company must meet the following conditions:
- at least 25% of the company's turnover in this activity must come from Bulgaria
- at least 25% of the company's employees performing this activity must work in Bulgaria
- the employees who will work in Belgium must have been insured for at least 2 months before their departure.
- the company must have been established for at least 6 months
For newly registered companies, the National Revenue Agency requires that the company has been carrying out real activity in Bulgaria for at least 4 months. If this condition is not met, the issuance of the A1 will be refused.
If A1 certificates cannot be issued for the employees, you can still work in Belgium, but for persons with an employment contract, social security contributions will be due, according to Belgian law, and accordingly you will have to pay social security contributions in Belgium.
We hope that we have been useful to you!
Best regards!
