Selling a site from a US company

Selling a site from a US company    accounting services, site, sale, vat, invoice, contract, company, registration, usa, ltd, plovdiv, burgas, sofia, ruse

Question:

Hello,
We discuss with a US firm an opportunity to develop a website from Bulgarian EOOD, registered under VATA under Article 100, paragraph 1.
The question that I am interested in is the form in which the sale of the website development service,
Is it sufficient: 1. The contract between the two parties
or should be issued: Invoice (in foreign language) and invoice of the Bulgarian. language from the Bulgarian EOOD to the US company (excluding VAT).
We charge VAT on the invoice and where it is in the VAT logbook.
The value of the service is in dollars and the payment will be by bank transfer
Are we required to issue a VIES statement, provided that the person is from a third party. And is the export service considered. Which member can we note for non-VAT?
The next question is: In 2016, we have been working on the website project but it has not been completed. How should we reflect the cost of creating the website at the end of 2016? (Maybe 611 remain with a debit balance?) And in 2017, which account is to be completed?
And the last question if you allow: In 2015 there were costs incurred (the company was opened in September), which we recorded as an expense and consequently a loss. Could this cost somehow affect in 2016 the cost of creating the website? (the cost is to pay for a program code store, server rental, purchase of project work programs, etc.)
Thank you very much for your time!
With respect to your labor.

Answer:

Hello,

On the issue of developing a website for a US firm, we can share that the sale (whether it is a product or service) of your company to another legal entity, regardless of where it is located, is registered by issuing an invoice language), which may state the price of the service in USD, but the final values must be in BGN. When a counterparty is not a Bulgarian legal entity, you may issue an Accompanying Invoice that is required for your counterparty (the value of the invite may be in US dollars only). The ground for non-charging VAT is Art. 86, para 3 of VATA (delivery with place of performance outside the territory of the country)

In determining your place of performance in your case, it does not matter whether the recipient is a taxable person (Article 21 (2) of the VATA) or is a non-taxable person (Article 21, Paragraph 5 of VATA). be included in the VIES declaration as VIES declarations only reflect deliveries made within the EU.

On the 2016 cost of creating the website, which is not yet complete by the end of the year. These costs should remain as work in progress (as long as they are differentiated and can be analytically separated from the costs of your other activities for 2016). In 2017, you will continue to accrue costs on this account, which will end revenue from selling the developed site. (group 70).

On the last question - there is no way to rework the lost at 2015 loss. But you do not lose any of this because if you declared in your annual tax return for 2015 the loss for carrying in the following years, then during one of the next 5 years you can tax your current tax profit for tax purposes in determining the taxes due reduce this loss and thus reduce the tax burden.

We hope we were useful to you.

Greetings.
