Payment of unemployment benefits to a partner in a company
Payment of unemployment benefits to a partner in a company
Question:
Hello!
My husband and I want to open a company for used parts, but he is on the stock exchange and receives unemployment benefits. My question is, if we open an LLC and he is a partner and I am a manager, will this be an obstacle to the benefits, will it not be stopped? Should we include him in the company now or after the stock exchange expires. What are the options for including him and providing him with insurance?
I am on an employment contract and if I leave on maternity leave, will double insurance prevent me from receiving benefits.
Thanks in advance!
Answer:
Hello,
Directly to your questions
Since your husband is only a partner, without being a manager and without being insured, there is no obstacle to continuing to receive benefits.
After the stock exchange expires, he can be accepted as a manager or be appointed on an employment contract. Acceptance as a manager goes through a procedure for entry in the Commercial Register, which is associated with some additional costs. With an employment contract, more social security contributions will be due. In any case, the option with acceptance of a manager is more advantageous in terms of costs. An employment contract would have an advantage if you decide to apply for a loan as an individual, since as a manager, your spouse will be self-insured, which is not considered a stable income by banks and often they do not even take it into account.
Regarding motherhood - at the moment this happens, your insurance must be suspended. This means that either the company's activities must be suspended or another manager must be appointed - a partner or an external person under a management contract.
