Employment contract and freelance

Employment contract and freelance

Question:

Hello.

I work on an indefinite employment contract, they provide me with 8 hours minimum wage. I want to register as a freelancer and continue to work at my current job. My cases are as follows:

1. As a freelancer, am I entitled to 4 hours of work on the minimum wage, provided that I do not have fixed hours? And if so, to what extent are the insurances?

2.When I do not have a company and a cash register, do I have to issue any kind of cash register analogue, and if so, what are they?

3. Do I have the right to choose which social risks to cover and, if so, which ones?

4. What tax returns should I file as a whole and at what periods?

Thanks!

Answer:

Hello,

Directly to your inquiry.

1. As a freelancer, am I entitled to 4 hours of work on the minimum wage, provided that I do not have fixed hours? And if so, to what extent are the insurances?

You are not entitled to 4 hours of insurance! Why? You must distinguish between a contract of employment and a self-employed person. In the employment contract you enter into a contract with the employer for / working time, place, activity, payment /. In the case of a self-insured person, you are not entitled to remuneration and are insured on the minimum insurance threshold for the self-insured person. You can work on an employment contract with the company you are currently working in and be a self-employed person / freelance /, you just have to keep in mind something important - when you register in the trade register as a freelancer to get an UIC, there there is a requirement to show a document certifying that you have the necessary qualifications to carry out a specific activity (diploma), if you do not have the right to register one EOOD with you.

2.When I do not have a company and a cash register, do I have to issue any kind of cash register analogue, and if so, what are they?

If you do not have a registered company and cash register - you work in the gray sector and risk fines from the state!

Recommendation - registration of the company and then you can buy a cash register and issue cash notes without a problem (no other analogues).

3. Do I have the right to choose which social risks to cover and, if so, which ones?

You are insured in the general order described in point 1 above.

4. What tax returns should I file as a whole and at what periods?

As a registered freelancer, all your income before tax is 10%, you are reduced by 25% of your legal expenses, without having to submit any expense documents.

A declaration under Article 50 of the Personal Income Tax Act (Law on Personal Income Taxes) shall be submitted by April 30 of the following year.

We hope we have been helpful.

Greetings!
