Question:

Hello,
For about a year and a half, I have earned income from advertising space in the Google AdSense program. I do not declare them anywhere and do not pay taxes for them. I am permanently unemployed. Recently, incomes have risen significantly. Is it my question, is it possible to start declaring this income, and how? Is it possible to get it without fines? I do not have a company, I do not have Bulstat. My idea is to remain a natural person and avoid most paperwork.

Answer:

Hello,

The activity you perform (providing services electronically to EU persons) is subject to a monthly declaration via VIES statement so that your customers can self-assess VAT in the country where they receive the service. For this purpose, the person carrying out this activity is registered under a special article in the VAT Act (Art. 97a), according to which the registered person only provides information about the provided services, as for all other activities he is as if he was an "unregistered person" until he fulfills the conditions for mandatory registration under the general rules. In order to be registered as a natural person, you have to practice the so-called "free" professions. The definition of liberal professions is defined in item 29. of paragraph 1 of the Supplementary Provisions of the Law on Taxes to Individuals: "Persons exercising a liberal profession" are: the accountants; consultants; auditors; lawyers; notaries; private enforcement agents; jury; court and prosecutors' experts; licensed appraisers; representatives of industrial property; medical specialists; translators; architects; engineers; technical managers; culture, education, art and science; insurance agents; other natural persons for whom both the following conditions are present:

(a) carry out, on their own account, a professional activity;

(b) are not registered as sole traders;

(c) are self-employed persons within the meaning of the Social Security Code.

It is clear that in order to "legalize the activity, you will have to establish a legal entity (OOD or EOOD) to continue doing business." Your obligation as a legal entity in relation to this activity you are doing and will now be to make the first advertising services on behalf of the new company) to register for VAT on the basis of Article 97a of the VAT Act, then you will have to start to pay contributions as self-insured person and you will no longer be unemployed. at the end of each anachen period (end of year) will declare their income and pay tax, but you will be relaxed about the sources of their income.

And last but not least, remember that you will need to keep an accounting and submit monthly VAT returns and insurance statements for your social security contributions.

If you have more questions, do not be afraid to ask them.

Greetings.
