Hello!

I need help calculating my paid leave. I went on paid leave after two years of maternity and pregnancy from October 24th, and I will use all the leave I am entitled to - 91 days from the specified date. Today I went to get paid for my leave. The boss said to give me BGN 400. They didn't let me sign a slip. I separately signed a document for the leave and a new contract, because My salary four years ago was BGN 510.00, and now it will be BGN 800, as I know that the minimum wage will increase next year. I need help calculating this amount. According to my calculations, I expected to receive more than BGN 500 - after all, I have a little more than a full month of paid leave.

Paid annual leave is calculated based on the average daily gross remuneration of the worker for the last calendar month preceding the month in which you go on paid leave, for which you have at least 10 days worked. This means that if you went on paid leave immediately after your maternity leave ended, then the last calendar month in which you have 10 worked days and which will be taken as a basis for calculation will be before you went on maternity leave, i.e. be calculated on the basis of BGN 510.00. It is difficult to assess whether your employer has paid you an adequate amount, since we neither know which is the last month in which you have 10 worked days, nor do we know exactly from which date you are on paid leave (the amount which you received may not be for a full month if, for example, you went on paid leave not from the first day of the given month).
If you still think that your rights have been violated in some way, you can contact the Labor Inspection office.
